These Terms and Conditions ("Terms") govern the use of our website, online business loan application system, and all related services provided by Batho Prestige Business (Pty) Ltd ("Batho Prestige Business", "we", "our", or "us").

By accessing or using our website or applying for a business loan, you agree to be bound by these Terms and our Privacy Policy. Please read them carefully before using our services.

2. Eligibility

To apply for a business loan through Batho Prestige Business, you and/or your business must:

  • Be a registered South African business (Pty Ltd, CC, Sole Proprietor, or Partnership).
  • Have all directors/owners be 18 years or older and South African citizens or permanent residents with valid ID.
  • Have been in operation for at least 12 months (or as specified for specific loan products).
  • Demonstrate a stable source of business revenue.
  • Provide accurate and complete information when applying for credit.
  • Hold a valid CIPC registration certificate (where applicable).

We reserve the right to verify your identity, business registration, employment, and financial information with third parties such as credit bureaus.

3. Definitions

"Agreement" means these Terms and any loan agreement concluded between you and Batho Prestige Business.

"Service" means the provision of asset-free (unsecured) business loans, SME financing, and related financial products through our online and physical platforms.

"Asset-Free Loan" means a loan that does not require collateral such as property, equipment, or other assets as security. Approval is based on your business's financial performance, cash flow, and creditworthiness.

"Website" refers to www.bathoprestigebusiness.co.za.

"You" / "Customer" / "Applicant" means any natural person or juristic entity who accesses our website, applies for, or uses our services.

"Business" means the registered entity applying for credit facilities.

4. Credit Assessment and Loan Approval

All business loan applications are subject to:

  • Credit and affordability assessment in line with the National Credit Act (34 of 2005).
  • Verification of business registration, financial statements, and credit history through registered credit bureaus.
  • Review of bank statements and cash flow analysis.
  • Assessment of director/owner creditworthiness.
  • Approval at the sole discretion of Batho Prestige Business.

We are legally prohibited from granting credit to businesses or individuals who are over-indebted or who fail affordability assessments.

5. Loan Agreement and Disclosure

If your application is approved, a formal Credit Agreement will be issued. That agreement will specify:

  • Loan amount and disbursement date
  • Interest rate (fixed or variable per NCA Regulations)
  • Initiation and service fees
  • Repayment term and frequency
  • Total cost of credit (including interest and charges)
  • Consequences of default and collection procedures

Note: Our loans are asset-free (unsecured). No collateral or property is required as security. Approval is based on your business's financial performance and creditworthiness.

You will be required to accept these terms electronically or in writing before funds are disbursed.

6. Fees and Interest

  • All interest and fees are charged strictly in accordance with Section 101 of the NCA and related regulations.
  • Batho Prestige Business does not charge any hidden or unauthorised fees.
  • You are entitled to a pre-agreement statement and quotation, valid for five (5) business days, before accepting a loan.
  • Full fee disclosure will be provided before loan acceptance.

7. Repayments

  • Repayments are made via debit order, EFT, or approved electronic payment methods.
  • You are responsible for ensuring that sufficient funds are available on the agreed dates.
  • Late or missed payments may attract additional default fees and interest in accordance with the NCA.
  • Repayment schedules will be clearly outlined in your loan agreement.

8. Default and Collections

If you fail to make payment on time, Batho Prestige Business may:

  • Notify you in writing of the arrears;
  • Report default information to registered credit bureaus;
  • Instruct registered debt collectors or attorneys;
  • Commence legal action in the appropriate court.

As our loans are asset-free, no property or assets will be seized. However, legal debt recovery processes will apply.

We comply with Sections 129 and 130 of the NCA before enforcing debt collection or legal proceedings.

9. Early Settlement and Pre-Payment

You may settle your loan at any time by paying the outstanding principal, interest, and authorised fees calculated up to the settlement date. A settlement statement will be provided upon request. Early settlement may result in reduced total interest charges.

10. Over-Indebtedness and Debt Review

If you believe your business or you personally are over-indebted, you have the right under the NCA to apply for debt review through a registered debt counsellor. Batho Prestige Business will cooperate fully with any lawful debt-review process.

11. Use of Website and Online Platform

  • You agree to use the Website lawfully and not to transmit harmful, defamatory, or fraudulent content.
  • All content on our Website, including text, graphics, logos, and trademarks, is owned by Batho Prestige Business and may not be reproduced without permission.
  • We reserve the right to suspend or terminate Website access for misuse or fraud.
  • You are responsible for maintaining the security of your account credentials.

12. Electronic Communication and Signatures

By using our online platform, you consent to receive communications, agreements, and disclosures electronically. Electronic acceptance or signature has the same legal validity as a physical signature under the Electronic Communications and Transactions Act (ECTA 25 of 2002).

13. POPIA and Confidentiality

  • Your personal and business information will be collected, processed, and stored in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy.
  • We will not share your data with third parties except as required for credit assessment, legal compliance, or debt recovery.

14. Marketing and Opt-Out

We may send you promotional offers only if you have consented. You may withdraw consent or unsubscribe from marketing at any time via email or SMS. Your withdrawal from marketing communications will not affect your existing loan agreement.

15. Limitation of Liability

While we take all reasonable care, Batho Prestige Business will not be liable for:

  • Loss or damage caused by unauthorised use of your login or information;
  • Indirect or consequential damages arising from the use of our services;
  • Temporary unavailability of the Website or system interruptions;
  • Business losses arising from delayed loan processing or declined applications.

Our total liability is limited to the amount of the credit extended to you.

16. Complaints and Dispute Resolution

We are committed to resolving customer complaints quickly and fairly.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the exclusive jurisdiction of the competent courts in the North West and Gauteng Province respectively.

18. Changes to These Terms

We may amend these Terms at any time. Updates will be posted on our Website with a revised date. Your continued use of our services after such changes constitutes acceptance of the updated Terms.

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
